These Terms of Service govern your access to and use of the Blissful Melody Design website, products, customization tools, applications, and related services.

Throughout these Terms, “Blissful Melody Design,” “we,” “us,” and “our” refer to Blissful Melody Design, LLC. “You” and “your” refer to the customer, website visitor, or other person using our services.

By visiting our website, submitting customization information, placing an order, or otherwise using our services, you agree to these Terms and our other published policies.

1. Eligibility

You must be at least 18 years old or the age of legal majority where you live to place an order. A minor may use our services only with the involvement and permission of a parent or legal guardian.

You agree to provide accurate, current, and complete account, contact, billing, shipping, and customization information.

2. Products and Services

We sell physical products, including personalized prints, star maps, welcome signs, bottle labels, event decorations, and related products.

Product descriptions, photographs, previews, dimensions, materials, colors, availability, and prices may be updated from time to time. We make reasonable efforts to present products accurately, but:

• Colors may vary between screens and printed materials.
• Natural materials, including solid wood frames, may have variations in grain, color, or texture.
• Product dimensions may have minor manufacturing tolerances.
• Product previews are visual representations and may not reproduce every physical characteristic exactly.

These reasonable variations are not defects unless the product materially fails to match its description or confirmed order.

3. Personalized and Custom Products

Personalized products are created using the information and selections you provide. Depending on the product, this may include:

• Names, dates, times, and locations
• Quotations, messages, or headings
• Customer-provided photographs or artwork
• Design, style, color, font, size, and material selections
• One or multiple star maps
• Other product-specific instructions

You are responsible for reviewing this information for accuracy before confirming an order.

If a required customization field is left blank, we may use a default value disclosed on the product page or in the customizer. For example, when a star-map time is not provided, 9:00 PM may be used as the default time.

If a proof or review step is offered, you are responsible for reviewing it carefully. Approval authorizes us to produce the product according to the approved information.

If the customization shown in the cart or checkout does not match your intended selections, do not complete the purchase. Contact us for assistance.

4. ChatGPT and Other Assisted Ordering Tools

We may make products and customization tools available through ChatGPT or other third-party assistants, applications, or platforms.

These services may help you:

• Discover eligible products
• Select variants and design styles
• Enter customization information
• Review order details
• Create a Shopify cart or checkout link

AI-generated explanations or recommendations may contain errors. You must review the final product, variant, price, customization details, shipping address, and order information before completing checkout.

The information shown in the final Shopify cart, checkout, and order confirmation represents the order submitted to us. If information supplied through an assistant conflicts with the checkout details, stop and contact us before purchasing.

Third-party services are also governed by their own terms and privacy policies. Their availability is not guaranteed. Nothing on a third-party platform should be interpreted as creating an endorsement or partnership unless expressly stated.

5. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order.

We may reject or cancel an order when reasonably necessary because of:

• Product or material unavailability
• An obvious pricing or listing error
• Incomplete or conflicting customization instructions
• Suspected fraud or unauthorized payment
• An invalid or unsupported shipping address
• Content that violates these Terms or applicable law
• An inability to fulfill the order within an acceptable period

If we cancel an order, we will notify you and refund the applicable amount to the original payment method.

We will not substitute a materially different product, design, size, or material without your consent.

6. Prices, Payments, and Taxes

Prices are displayed in the currency identified on the website. Shipping charges and applicable taxes are calculated and displayed during checkout.

You authorize us and our payment processors to charge the payment method you provide for the total shown at checkout.

If we discover a material pricing error before fulfillment, we may contact you and offer the choice of confirming the corrected price or canceling the order for a full refund. We will not charge an increased amount without your authorization.

We collect and remit sales tax in jurisdictions where we are legally required to do so.

If we do not collect sales tax on an order, the customer may be responsible for reporting and paying applicable use tax, sales tax, or similar taxes directly to the appropriate state or local tax authority, as required by applicable law.

The absence of tax at checkout does not necessarily mean that no tax is owed. Nothing in these Terms transfers to the customer any tax that Blissful Melody Design is legally required to collect or remit.

7. Production and Shipping

Production times and shipping transit times are separate. Most products are prepared for shipment within the production period shown on the product page or in our Shipping Policy.

Personalized production may begin shortly after an order is placed. If we cannot ship within the promised period, we will provide notice and any delay, cancellation, or refund options required by applicable law.

Shipping destinations, rates, tracking, customs charges, address corrections, carrier delays, lost packages, and damaged shipments are governed by our Shipping Policy.

8. Cancellations, Returns, and Refunds

15-Minute Cancellation Period

You may cancel an order within 15 minutes after completing the purchase using the cancellation option provided with your order or by contacting us through an available cancellation method.

The 15-minute period begins at the order time recorded by our system. If a valid cancellation request is submitted within that period, we will cancel the order and issue a full refund to the original payment method.

Although we process approved cancellations promptly, your bank or payment provider may require additional time to release an authorization or post the refund.

After the Cancellation Period

After the 15-minute cancellation period expires:

• Cancellation or modification is not guaranteed.
• Production of a personalized product may have already begun.
• Personalized and made-to-order products generally cannot be canceled, returned, or exchanged.
• If a non-customized order has not entered fulfillment, contact us immediately and we will determine whether cancellation is still possible.
• Eligible non-customized products may still be returned after delivery according to our return policy.

Personalized products cannot ordinarily be returned because of a change of mind, customer preference, an incorrectly selected option, or information entered and confirmed by the customer.

This restriction does not apply when a product:

• Arrives damaged or defective
• Is materially different from the confirmed order
• Is the wrong item
• Contains an error caused by our production process
• Is otherwise eligible for a remedy under applicable law

The 15-minute cancellation period does not limit any separate right to cancel because of a shipping delay or another right provided by applicable law.

9. Customer-Submitted Content

“Customer Content” includes text, names, photographs, images, quotations, artwork, logos, instructions, or other material you submit.

You retain any rights you already own in your Customer Content. By submitting it, you grant us a limited, non-exclusive, royalty-free license to use, copy, modify, format, reproduce, and process it only as reasonably necessary to:

• Create and fulfill your order
• Provide previews or proofs
• Communicate with you about the order
• Resolve customer-service or legal issues
• Maintain legally required business records

We will not use personalized Customer Content in public advertising without separate permission, except where otherwise permitted by law.

You represent that you have the necessary rights and permissions to submit and use Customer Content. You may not submit content that:

• Infringes copyright, trademark, privacy, publicity, or other rights
• Is unlawful, fraudulent, threatening, hateful, or abusive
• Contains malware or harmful code
• Promotes illegal activity
• Violates another person’s privacy
• Impersonates another person or organization

We may refuse or cancel an order containing prohibited content.

10. Intellectual Property

The website and its contents—including product templates, layouts, graphics, illustrations, logos, photographs, software, customizer interfaces, and written material—are owned by or licensed to Blissful Melody Design and are protected by applicable intellectual-property laws.

Purchasing a personalized product gives you ownership of the physical item. It does not transfer ownership of our underlying templates, artwork, software, production files, design systems, or intellectual property.

Unless we provide written permission, you may not reproduce, resell, distribute, scrape, reverse engineer, or commercially exploit our designs, website content, customization tools, or software.

11. Acceptable Use

You may not use our website or services to:

• Violate any applicable law
• Commit fraud or interfere with another customer’s order
• Attempt unauthorized access to our systems
• Introduce viruses, malicious code, or automated attacks
• Scrape or collect website data without permission
• Circumvent security, purchase, or customization controls
• Misrepresent your identity or payment authority
• Infringe our rights or the rights of another person

We may restrict access when reasonably necessary to protect customers, our business, or our systems.

12. Star Maps and Generated Designs

Star maps and other generated designs are personalized decorative artwork. They are not intended for scientific research, astronomy instruction, navigation, emergency planning, or other uses requiring professional accuracy.

We use the date, time, and location submitted or confirmed by the customer. The customer is responsible for verifying that information before ordering.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy.

Customization information may be processed by service providers needed to operate our store, create the product, host our systems, process payments, and arrange delivery. Third-party ordering platforms may process information under their own privacy policies.

14. Third-Party Services

Our store may rely on or link to third-party services, including Shopify, payment processors, shipping carriers, cloud-hosting providers, ChatGPT, and other applications.

We are not responsible for independent third-party websites or services outside our control. However, this provision does not remove our responsibility for fulfilling your order or providing remedies required by law.

Your use of a third-party service may also be subject to that provider’s terms and privacy practices.

15. Service Availability and Errors

We may update, suspend, or discontinue parts of the website or customization service. We do not guarantee uninterrupted access or that every feature will always be available.

We may correct typographical, pricing, product, availability, or technical errors. Corrections will not remove rights arising from an order we have already accepted except as permitted by applicable law.

16. Disclaimers

To the fullest extent permitted by law, the website and online customization tools are provided on an “as available” basis.

We do not exclude or disclaim:

• Obligations expressly stated in these Terms
• Statutory warranties that cannot legally be excluded
• Responsibility for damaged, defective, incorrect, or nonconforming merchandise
• Liability that cannot be limited under applicable law

17. Limitation of Liability

To the fullest extent permitted by law, Blissful Melody Design will not be liable for indirect, incidental, special, or consequential losses resulting from use of the website or services when those losses were not reasonably foreseeable.

Where liability may legally be limited, our total liability arising from a particular order will not exceed the amount paid for that order.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by legally actionable conduct, or any liability that cannot be excluded or limited under applicable law.

18. Responsibility for Claims Relating to Customer Content

To the extent permitted by law, you are responsible for claims arising from Customer Content you submitted without the required rights or permissions.

This section does not apply to claims caused by our independent actions, modifications you did not authorize, or conduct for which we are legally responsible.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable federal laws of the United States, without regard to conflict-of-law principles. This choice of law does not deprive consumers of any mandatory protections provided by the laws applicable where they reside.

Before filing a legal claim, you and Blissful Melody Design agree to make a reasonable effort to resolve the dispute by contacting the other party. This requirement does not prevent either party from seeking urgent relief or using rights that cannot legally be restricted.

20. Changes to These Terms

We may update these Terms to reflect changes in our services, business practices, or legal requirements.

The revised Terms will display a new “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. The Terms in effect when an order is placed generally govern that order.

21. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

These Terms, together with the policies and product-specific terms referenced here, constitute the agreement between you and Blissful Melody Design concerning use of the store and your purchases.

A failure to enforce a provision does not waive the right to enforce it later.
